The user or customer of the website and online store Vrtnarstvo Marolt regulate their mutual rights and obligations related to electronic purchases with the general terms and conditions of the Vrtnarstvo Marolt online store, which are composed in accordance with the Consumer Protection Act (ZVPot), the recommendations of the Chamber of Commerce and Industry of Slovenia, and international codes for e-commerce. The general terms and conditions are regularly updated, and the latest and valid version is available to everyone in its entirety. Deviation from the general terms and conditions is only possible in case of a special written agreement between the Vrtnarstvo Marolt online store and the user or customer. All communication conducted in electronic form between the user or customer and Vrtnarstvo Marolt is considered to be in written form and has the validity of a contract. By confirming the order, the user is familiar with the general terms and conditions, personal data protection, and legal notice. SHOPPING PROCESS
1. Select the product or products you want to purchase. Click on the Add to Cart button. 2. The total amount of the ordered items will be displayed at the top right. If you want to remove or decrease the quantity of a specific item, you can do so in the cart.
3. When you finish shopping, click on the Cart button at the top right.
4. The Cart will be displayed, where you can find the selected items and their quantity. On the right column, select the delivery method. Packaging is not included in personal pickup, but it is included in the price of our delivery. The total purchase amount will be displayed at the bottom.
5. At the bottom right, you can enter a discount code by clicking on ‘Have a coupon?’ and confirm the code with the button on the right. To continue shopping, select Checkout at the bottom.
6. In the next step, enter your contact information.
7. Deliver to a different address? – You can choose to deliver to a different address or proceed to the end of the purchase with the Continue to next step button.
8. An additional window will appear, where you can indicate whether you want to receive photos of the ordered plants before delivery. Check the delivery option above. 9. Payment – fill in your card details for payment.
10. Submit your order with the Submit Order button.
11. The order has been submitted.
12. Order summary – you will receive it at the email address you provided during purchase. Check the accuracy of the ordered items and the delivery address or personal pickup.
Larger quantities can also be ordered via email at shop@vrtnarstvo-marolt.si, where we will arrange all the details.
The purchase agreement for the ordered products between the buyer and the provider is irrevocably concluded upon purchase. By clicking on the “Submit Order” button, you confirm that you are familiar with the entire text of the sales and payment terms, which are listed here, and that you were explicitly warned of these terms at the time of purchase. The purchase agreement (order) binds the online store and the buyer. In the event that the buyer orders products in the online store and then rejects or does not accept the shipment, the buyer bears the shipping costs in both directions. The price of shipping is determined by the delivery service. The order is considered a purchase agreement and is stored electronically on the provider’s server and sent to the buyer via email, and is available to the buyer upon written request. Vrtnarstvo Marolt online store has the right to reject an order. In this case, the buyer will be notified of the rejection by email to the address from which the order was sent.
TYPES OF USERS
The right to purchase on the online store https://shop.vrtnarstvo-marolt.si/ is available to all guests who make a quick purchase and do not need to register before purchasing.
Access to the stored contract is possible through the online store, where all contracts between the buyer and the seller are always available for viewing. The buyer receives confirmation of the order via email.
AVAILABILITY OF INFORMATION
The provider undertakes to always provide the following information to the buyer: a) the identity of the company (name and registered office, registration number), b) contact information that allows the user to communicate quickly and effectively (email, phone), c) the essential characteristics of the goods or services (including after-sales services and warranties),
d) the availability of products (each product or service offered on the website should be available within a reasonable time),
e) the terms of delivery of the product or performance of the service (method, place and deadline of delivery),
f) all prices must be clearly and unambiguously specified,
g) the payment and delivery method,
h) the time validity of the offer,
i) the deadline for withdrawing from the contract and the conditions for withdrawal, as well as whether and how much it costs the buyer to return the product,
j) an explanation of the complaint procedure, including all contact information for communicating with customers.
PAYMENT METHODS
The provider offers the following payment methods:

The cost of delivery and packaging is displayed in real-time in the shopping cart and is automatically linked to the weight of each item. The delivery cost shown in the cart is final, and no additional charges will be applied. In the case of personal pick-up, the packaging (pot) of individual seedlings is included in the price of the item, but the pallet packaging is not included.
DELIVERY
When making a purchase, personal pickup is possible, for which no additional costs are charged. In this case, the plants are not packaged in transport packaging.
Delivery within Slovenia is carried out by the delivery service Pošta Slovenije or the company Vrtnarstvo Marolt d.o.o., or in exceptional cases by another delivery service.
The delivery time is 7 days for items in stock or 10-14 days for items that are not in stock, unless otherwise stated when ordering. The deadline for delivery of the ordered goods starts the day after receipt of payment to the account of Vrtnarstvo Marolt. Due to the seasonal nature of sales, we reserve
the right to cancel certain items that are not in stock. We will inform the customer about this by email or phone.
The delivery cost is calculated according to the price list (prices include VAT) and depends on the weight of the ordered goods and the delivery location. The postage amount is displayed to the customer before placing an order in the shopping cart.
PRICES
All prices include VAT. Prices are valid at the time of placing the order and are not predetermined. Prices apply in case of payment with the payment method specified above, under the conditions stated above. The contract is concluded when the buyer receives confirmation from Vrtnarstvo Marolt about the submitted order. From this moment on, all prices and other conditions are determined and apply to both the provider and the buyer.
INVOICE ISSUANCE
After payment for the ordered items, the seller sends an invoice in PDF format to the buyer’s email address. The buyer also receives a physical invoice upon delivery or personal pickup. The invoice includes a breakdown of the price and all costs related to the purchase. The buyer is responsible for verifying the accuracy of the information before submitting the order.
WITHDRAWAL FROM ORDERED GOODS
n accordance with the Consumer Protection Act (ZVPot), the buyer has the right to return purchased goods without stating a reason. The buyer must inform the provider in writing about the intended return, no later than 14 days after receiving the goods, and return the goods within the next 14 days. The address for returning the goods to the seller is Vrtnarstvo Marolt, MAROLT production, trade, and services Ltd., Ločiška cesta 6, 3313 Polzela, Slovenia.
The postal service Pošta Slovenije takes care of the return/transport of the plants to the seller.
Please prepare the goods for transport accordingly (you can use the original packaging or other suitable safe packaging). Any return costs are covered by the seller. The seller returns received payments to the consumer using the same payment method used by the consumer, unless the consumer has expressly requested the use of another payment method, and the seller does not bear any costs for it. We also allow product exchanges in our online store.
The return process can be initiated by contacting us via email at shop@vrtnarstvo-marolt.si and completing the form for asserting the right to withdraw from the contract (the form is sent to the buyer’s email).
Complaints
The pictures published on the Vrtnarstvo Marolt online store are informative and symbolic. They depict different stages of plant growth, with the colors, flowers, and fruits of the delivered plants potentially differing significantly from the informative pictures due to the nature of the plants and seasonal availability. Given that the plant offerings change daily, Vrtnarstvo Marolt cannot guarantee a product that is entirely identical to the informative product picture on the online store. When ordering products, therefore, we offer the option for the customer to request photographs of the sent plants. In this case, we send the photographs to the customer for confirmation before sending the order, and we only send the order if it is confirmed or if the customer does not respond within two days.
To make a complaint, it is necessary to deliver the goods together with the purchase confirmation. In the event that it is determined that the buyer has handled the product improperly, wastefully, negligently, or in the event that the complaint is due to force majeure or mechanical damage caused by the buyer, the complaint is not valid. Additionally, the complaint is not valid if the buyer does not provide a purchase confirmation for the purchased goods.
Return of damaged shipment, damages during transportation
The buyer is obliged to check the shipment or its contents upon receipt. In case the package is physically damaged, the contents are missing or there are signs of opening, the buyer must initiate a complaint process with the delivery service (Pošta Slovenija). To do this, return the package in the same condition as received (without adding or removing anything) after inspecting it, and fill out a complaint form. Together with Pošta Slovenija, we will ensure that the complaint is resolved as quickly as possible.
Disclaimer of liability
The provider strives to ensure the timeliness and correctness of the information published on its website to the best of its ability. However, product properties, delivery times, or prices may change so quickly that the provider is unable to update the information on the website. In such a case, the provider will inform the buyer of the changes and allow them to cancel the order or exchange the ordered product.
Out-of-court dispute resolution
In accordance with legal norms, we do not recognize any out-of-court dispute resolution entity as competent to resolve consumer disputes that a consumer could initiate in accordance with the Consumer Dispute Resolution Act.
Data Protection
The provider undertakes to permanently protect all user’s personal data. The provider will use personal data solely for the purpose of fulfilling the order (sending informative material, offers, invoices) and other necessary communication. User data will not be disclosed to unauthorized persons under any circumstances.
Communication
The provider will contact the user through remote communication channels only if the user does not object explicitly. Advertising electronic and/or SMS messages will contain the following components:
• Clearly and unambiguously marked as advertising messages,
• The sender will be clearly identifiable,
• Different actions, promotions, and other marketing techniques will be marked as such. • Likewise, the terms of participation will be clearly defined:
• The method of unsubscribing from receiving advertising messages will be clearly presented, • The provider will explicitly respect the user’s desire not to receive advertising messages.

The trademark Vrtnarstvo Marolt or www.vrtnarstvo-marolt.si or www.shop.vrtnarstvo-marolt.si and logo are owned by the company Vrtnarstvo Marolt.
Complaints and Disputes
The provider respects the applicable consumer protection laws. The provider makes every effort to fulfill its duty to establish an effective system for handling complaints and to designate a person with whom the customer can contact by phone or email in case of problems. Complaints can be submitted via email to shop@vrtnarstvo-marolt.com. The complaint handling process is confidential. The provider will confirm receipt of the complaint within five working days, inform the customer how long it will take to handle the complaint, and keep them informed throughout the process. The provider is aware that the essential characteristic of a consumer dispute, at least with regard to judicial resolution, is its disproportion between the economic value of the claim and the costs incurred in resolving the dispute itself. This is also the main obstacle that prevents the consumer from bringing a dispute before a court. Therefore, the provider strives to resolve any disputes amicably. Ensuring the quality of goods and satisfied customers are our main priorities.
Quailty and Warranty
We carefully select all of our products and also cultivate and maintain them carefully. All products are carefully inspected before being shipped. All shipments are properly packaged to prevent damage.
However, in the event of damage, we will immediately replace the products based on your photo or refund the purchase price and shipping costs.
All plants that we sell in pots and are sold during their dormancy period have a one-month warranty. If the plant does not grow during this time, we will replace the plant with a new one or refund the purchase price including shipping costs.
Material Defect
A material defect can be claimed if you believe that the purchased product did not have the necessary qualities for its normal use at the time of purchase or in other cases specified by the Consumer Protection Act. Please notify us of the defect no later than within two months of discovering it and choose to demand the correction of the defect, a proportionate refund of the paid amount, replacement of the goods, or a refund of the paid amount. Please send us the product for inspection with a precise description of the defect. In cases where the reported defect is not disputed, we will fulfill the request within 8 days of receiving the product. If there is a dispute about the defect, you can expect a written response from us within 8 days. The consumer’s rights expire two years from the day when they notified the seller of the material defect.
